1. Acceptance of Terms

By accessing or using our websites (nexttuberllc.com), applications, APIs, or software services (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service. If you are entering into this agreement on behalf of a corporate entity, company, or talent agency, you represent that you hold the legal authority to bind that entity.

2. Software License & Permitted Use

NextTuber LLC grants you a non-exclusive, non-transferable, revocable license to access and use our software strictly for your internal business operations, campaign modeling, and creator sponsorship dealmaking. You agree not to:

• Reverse-engineer, decompile, or extract the source code of NextTuber platforms;
• Circumvent rate limits, IP restrictions, or API security shields;
• Resell or redistribute aggregated raw creator database records without written enterprise authorization.

3. YouTube API Services Acknowledgment

Certain features of our Services rely upon the YouTube Data API v3. Users of NextTuber acknowledge and agree that access to YouTube data is subject to the YouTube Terms of Service and Google developer standards.

4. Subscriptions, Payments & Taxes

Commercial subscriptions to NextTuber software are billed in US Dollars ($ USD) on a recurring basis. All fees are exclusive of applicable federal, state, or municipal taxes unless explicitly stated. Subscriptions may be cancelled at any time through your account portal prior to the next billing cycle.

5. Intellectual Property

All copyrights, trademarks, service marks, algorithms, codebases, user interfaces, and brand assets associated with NextTuber LLC and the NextTuber platform remain the sole and exclusive property of NextTuber LLC and its licensors.

6. Limitation of Liability

To the maximum extent permitted by applicable law, NextTuber LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or influencer partnership opportunities arising out of your use of the Services.

7. Governing Law & Jurisdiction

These Terms shall be governed by, and construed in accordance with, the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any legal proceeding arising hereunder shall be brought exclusively in the state or federal courts located in Wyoming, USA.
